Die österreichische Finanzmarktaufsichtsbehörde (FMA) kann ua gemäß § 4 Abs 7 BWG die Öffentlichkeit informieren, dass eine namentlich genannte natürliche oder juristische Person zur Vornahme bestimmter Bankgeschäfte (§ 1 Abs 1 BWG) nicht berechtigt ist, sofern diese Person dazu Anlass gegeben hat und eine Information der Öffentlichkeit erforderlich und im Hinblick auf mögliche Nachteile des Betroffenen verhältnismäßig ist.

Mit Bekanntmachung im Amtsblatt zur Wiener Zeitung vom 30.10.2018 teilt die FMA daher mit, dass

nicht berechtigt ist, konzessionspflichtige Bankgeschäfte in Österreich zu erbringen. Es ist dem Anbieter daher die Teilnahme an der Emission Dritter eines oder mehrerer der in Z 7 lit. b bis f BWG genannten Instrumente und die diesbezüglichen Dienstleistungen (Loroemissionsgeschäft gem. § 1 Abs 1 Z 11 BWG) nicht gestattet.

The Austrian Financial Market Authority (FMA) may, inter alia, inform the public in accordance with § 4 (7) BWG that a named natural or legal person is not entitled to carry out certain banking transactions (§ 1 (1) BWG), provided this person has given reason to do so Information required by the public and proportionate to possible harm to the person concerned.

With publication in the official gazette „Amtsblatt zur Wiener Zeitung“ of 30.10.2018 the FMA informs that:

is not entitled to perform banking transactions requiring a license in Austria. It is the provider, therefore, the participation in the issue of third parties of one or more of the in Z 7 lit. b to f BWG and the related services (LoroEmission business pursuant to § 1 para 1 no. 11 BWG) are not permitted.
