The Austrian Financial Market Authority (FMA) may, inter alia, in accordance with § 4 para 7 BWG inform the public that a named natural person or legal entity is not authorized to carry out certain banking transactions (§ 1 Abs 1 BWG), if this person has given cause and one Information required by the public and proportionate to possible harm to the person concerned. With announcement in the official gazette to the Wiener Zeitung from 01.02.2019 the FMA announces therefore that

is not entitled to perform banking transactions requiring a license in Austria. Therefore, the provider is not allowed to commercially accept third-party funds for administration (§ 1 (1) (1) first case BWG).

Mit Bekanntmachung im Amtsblatt zur Wiener Zeitung vom 01.02.2019 teilt die FMA daher mit, dass

nicht berechtigt ist, konzessionspflichtige Bankgeschäfte in Österreich zu erbringen. Es ist dem Anbieter daher die gewerbliche Entgegenahme fremder Gelder zur Verwaltung (§ 1 Abs 1 Z 1 erster Fall BWG) nicht gestattet.
