Die Österreichische Finanzmarktaufsichtsbehörde (FMA) kann ua gemäß § 4 Abs 7 BWG die Öffentlichkeit informieren, dass eine namentlich genannte natürliche oder juristische Person zur Vornahme bestimmter Bankgeschäfte (§ 1 Abs 1 BWG) nicht berechtigt ist, sofern diese Person dazu Anlass gegeben hat und eine Information der Öffentlichkeit erforderlich und im Hinblick auf mögliche Nachteile des Betroffenen verhältnismäßig ist.

Mit Bekanntmachung im Amtsblatt zur Wiener Zeitung vom 30.10.2018 teilt die FMA daher mit, dass die

nicht berechtigt ist, konzessionspflichtige Bankgeschäfte in Österreich zu erbringen. Es ist dem Anbieter daher der gewerbliche Handel auf eigene oder fremde Rechnung (§ 1 Abs 1 Z 7 BWG) nicht gestattet.

is not entitled to perform banking transactions requiring a license in Austria. Therefore, the provider is not permitted to trade on its own or for another’s account (§ 1 para. 1 no. 7 BWG).
