
The German Bundestag has clearly rejected the introduction of a “double contradiction solution” for organ donation. The draft of a group of MPs around Health Minister Jens Spahn (CDU), according to which everyone is to be considered a donor until further notice, did not find a majority today.
379 MEPs voted against, 292 MPs supported the motion, three abstained.
Address the issue every ten years
Then, at second reading, the parliament approved a draft brought in by a group led by Greens leader Annalena Baerbock and left chair Katja Kipping. It essentially adheres to the applicable law. He suggests that all citizens be addressed about organ donation at least every ten years.
Anyone who requests an identity card, extends it or obtains a passport from the age of 16 should receive information material from the office. When picking up, you should then be able to register on the spot or later at home in a new online register – with yes or no. Offices are explicitly not supposed to advise themselves.
Austria with a contradiction
In Austria, the objection solution applies to organ removal from the deceased. This was recommended as a regulation by the Council of Europe in 1978. The basic solution to the objection is that organ removal is permissible if the deceased did not expressly object to it during his lifetime.
However, the objection of the legal representative before the death of the data subject also counts as an objection in this country.
