
The former leader of the right-wing populist alternative for Germany (AfD) Frauke Petry has lost the legal battle with her former party for the brand „The Blue Party“. The Higher Regional Court (OLG) Munich today dismissed an appeal of the politician against a previous judgment of the Landgericht München. Petry has to cancel her registered trademark „The Blue Party“. Whether she will proceed against the verdict, her lawyer could not say according to dpa yet.
Petry founded the „Die blaue Partei“ in 2017 after her withdrawal from the AfD, which was staged with media influence, and registered the logo as a trademark at the German Patent and Trademark Office. The AfD was with their brand „The Blue“ but about two weeks faster and demanded to delete the mark.
In the name of Petry’s new party, the verdict, however, has no effect. „A party does not need a brand for its actual tasks,“ said a spokesman for the German Patent and Trademark Office. „Brands are only important for parties if they want to sell something.“ That could be the case with T-shirts, for example.
